A man is suing the City of
Austin and eight police officers for false arrest. In a federal claim, Pete
Hernandez says while leaving a Walmart in 2012 he walked by a car reported
stolen in the parking lot, and was told to get on the ground. Hernandez was not
connected to the stolen car. He claims he was falsely arrested and attacked by
the officers and that he blacked out. The suit asks for medical and legal
damages, a change in Austin police use of force policies and a trial by jury.

Man sues city, police for
accused false arrest
TRAVIS COUNTY -- A Travis
County man is suing the City of Austin, and eight Austin Police officers, for a
false arrest and beating back in June 2012.
According to the lawsuit, Pete
Hernandez says police falsely arrested him in a Walmart parking lot when he
walked by a car that had been stolen.
The lawsuit says police
demanded Hernandez get on the ground and he hesitated.
Hernandez says the officers
violently forced him to the ground and either beat him or failed to stop other
officers from beating him. Hernandez says sometime during the altercation he
blacked out.
