Off-duty cop, two others arrested in Wallkill assault

WALLKILL – Three men including an off-duty NYPD Bronx Housing cop have been arrested by Wallkill Town Police and charged with assault in connection with the attack on two men.
The incident occurred at around 3:37 a.m. on Wednesday, May 29 when the two victims were at the West Gate Bar at 245 West Main Street in Middletown. Joshua Tice, the off-duty police officer, agreed to take the two men home and when they got to a residence at 429 Route 211 West in Wallkill, Tice and two other men, who were passengers in his car, attacked them.
Tice, 25, of Logtown Road in Port Jervis, as well as Justin Diesel, 25, and Kyle Diesel, 21, both of Horton Road in Westtown, were all charged with assault.
Both victims are 23 years old. One was treated at the hospital and the other sought care from a private physician for a concussion, said Wallkill Police Chief Robert Hertman.
During the follow up investigation by Wallkill Detective Julia Ashworth, she learned that Tice was a cop. At 12:30 p.m., he was taken into custody at his residence by Ashworth. A short time later, the Diesels were arrested at their home.
The NYPD Housing Bureau Investigations Unit responded and assisted in the investigation.
All three suspects were issued appearance tickets on the misdemeanor assault charge.
